There were 24 cases in the docket in Justice Samzar Shagug’s court:

3 were illegal entry into Israel, 7 were membership and activity in an unlawful organization, and the rest charges of shooting, manufacturing and throwing of fire bombs and other terrorist acts.

Tamer Raed Muhammad Shanan – ID 854864832

Tamer is accused of manufacturing and throwing a firebomb. He denies the allegations.

An evidentiary hearing is set for 9.12.13.

 

Masaeb Sami Mustafa Awad – ID 852276591

Masaeb is accused of membership and activity in an unlawful organization. He denies the allegations.

An evidentiary hearing is set for 2.12.13.

 

Muhammad Haled Ali Takatka – ID 941190563

Atty. Qawasme reports that an agreement has been reached.

According to the revised indictment, while Muhammad Takatka was in jail, the head of Hamas in jail approached him and asked if had received the forms for reimbursement for his imprisonment. Muhammad said he had not, but he gave the man the phone number of his aunt who was in touch with people in Jordan. Consequently, $2000 were received by the aunt who then gave the money to Muhammad’s father and he deposited it at the Al Islami bank. Six months later another 2000 were transferred, and in 2012 the parents received 1000 dollars.

In his decision, the judge states that Muhammad brought enemy money into the territory, money paid him because he was in Israeli jail. However, the crime was committed while he was in jail and a long time passed since. There is “evidentiary difficulty” in proving the transfer of money. The money served for personal uses and was not transferred to any organization.

Sentence: 3 months in prison, 5 months suspended sentence for 3 years if the same violation is repeated, plus 5000 shekels fine.

 

Mahmoud Muhammad Hasin Abu Alaish – ID 850026316

The attorney reports that negotiations are on the way toward a plea bargain.

The next hearing is set for 2.12.13.

Nessim Yihiya Muhammad Amatir – ID 852412543

There is a plea bargain in place.

Amatir is charged that in December 2012 he threw rocks at a vehicle 5 meters away, missing it. In March 2013 his friend threw a pipe bomb, but he himself and several others threw only rocks.

Amatir was convicted of rock throwing. The judge cited his young age – 21 -  and sentences him to 6 months and a day, 6 months suspended sentence for 4 years for any violation involving rock throwing plus a 2000 shekel fine.

 

The next case was heartrending. A 16-year old boy (who looked much younger) was sitting alone on the bench; no family member was in the court.

 

Hamdallah Adel Yusuf Abu Alia – ID 401722780

Atty. Samara told us that the family had been notified of a hearing on Tuesday. The office then changed the date without notifying the attorney, who therefore did not notify the family, so none of them showed up in court.
