Judge’s decision:
The accused was arrested last night (11.11.18). He is suspected of membership and activity in an illegal organization and with providing services to said organization. The defense claims that the arrest was based on military intelligence, which is the sole basis of his arrest. But the investigator has presented a confidential file enumerating the info and evidence that led to the arrest. There is additional material in the file to warrant remand extension: there is evidence that ties the suspect to threat to security in the region.
Decision: 8-day remand extension.
Diaa Walid Mussa Hamed – ID 852351139
Born: 10.1.91, resident of Silwad.
He was arrested on 15.10.18
There is agreement between the sides on 8-day remand extension and transferring the case to the prosecution.
Muhammad Ahmed Mahmoud Awada – ID 4023328975
Born: 10.11.97, resident of Baraj Village (Near Hebron)
He was arrested on 3.11.18.
The investigator requests 8 additional days. The charges are membership and activity in Hamas and providing services to the organization.
Defense: Judd Kamani, Maamoun Hashim.
After conferring with the detainee, the defense argues that the charges are merely a recycling of old charges.
The defense accepts the judge’s suggestion: remand until Thursday, then check to see where the investigation is going.
Omar Ahmad Ali Karakra – ID 949794176
Born: 19.1.1985, resident of Bethlehem.
He was arrested on 11.11.18.
Charge: membership and activity in a hostile organization, and providing services for said organization.
It transpires that Baduan and Karakra collaborated in the violation of which they are accused.
The investigator requests 12 days.
From questions the defense addresses to the investigator, we learn that the charges are recent. When asked: “Is the arrest based on information or evidence?” and “Are others implicated?” the investigator refers to the secret file.
The secret file includes both Baduan and Karakra.
The suspect rejects the charges vehemently.
Judd Kadmani and Maamoun Hashim claim that the detainee has been sleep deprived. Since his arrest he has been allowed to sleep only 2 hours,
Judge Heilbronn decides on 8 days remand extension, and in view of the defense’s claim that the detainee has slept only 2 hours since his arrest, the head of the investigation team will see to it that the detainee is allowed to rest before continuing the interrogation.
